Boehner may intervene soon against gay troops? DOMA lawsuit
WASHINGTON ? A Republican-led House panel may intervene as soon as next week against litigation that aims to overturn the Defense of Marriage Act on the grounds that it unfairly prohibits gay troops from obtaining benefits for their same-sex spouses.
The litigation, known as McLaughlin v. Panetta, was filed on behalf of gay troops and veterans by Servicemembers Legal Defense Network and Chadbourne & Parke LLC. It?s pending before the District Court of Massachusetts.
Christopher Man, counsel at Chadbourne & Parke LLC, told the Blade via email on Saturday he believes the Bipartisan Legal Advisory Group, led by House Speaker John Boehner, is ?likely to intervene soon, possibly as soon as next week? and plaintiffs will oppose the intervention.
The Justice Department sent notification to Congress last month that it wouldn?t defend DOMA in the McLaughlin case ? keeping in line with President Obama?s determination last year that the anti-gay law was unconstitutional ? as well as provisions in Title 10, Title 32, and Title 38 of the U.S. Code prohibiting gay troops from receiving benefits.
Boehner?s panel, which took on defense of DOMA last year following a 3-2 party-line vote in the administration?s stead, is already defending the statute in other cases challenging its constitutionality.
On Feb. 9, Chief Warrant Officer Charlie Morgan, a lesbian in the New Hampshire National Guard and plaintiff in the gay troops? lawsuit, met with Boehner?s staff to ask the Ohio Republican to stop defending DOMA in court, but was told he?ll likely continue defense of the law. She?s been diagnosed with stage-four incurable breast cancer and is seeking survivor benefits that are awarded to veterans in opposite-sex marriages for her spouse, Karen Morgan.

iPad 2 Refurbished vs New
Hey guys,
I am going through a slight buyer remorse right now as I have placed an order for a refurbished iPad 2 16GB version via Apple as I thought the $349 price tag was hard to resist. Soon enough, I have realized the regular price for these are $399 and if I order from other authorized retailers like B&H, I don't get taxed. (They offer free shipping too)
I did the math and with the cash back, the price difference is only roughly $25 between the new one and the refurbished one. $375 vs $399
I know how Apple refurbs are (they look new and work just as good) but in the long run, will there be any disadvantages for going this route? (Loss in profit because of the refurb box.. etc)

MADISON, Wis. (AP) ? Hundreds of cultured spectators nibbled on cheese and crackers, waiting patiently for an hour as dozens of judges deliberated Wednesday night before naming a Dutch Vermeer the world's best cheese.
What was once a low-key industry affair noticed only by a handful of spectators and reporters is now a must-have ticket for those looking to get their gouda on. The World Champion Cheese Contest sold out of all 400 tickets in the first year they were offered; the artisan cheese competition has become another way for foodies to outdo one another in the pursuit of local, sustainable and handcrafted fare.
The contest, held every two years in Madison, typically draws more than 2,000 entries from nearly two-dozen nations. Usually only the judges taste the cheese, but this year's ticketholders sampled 15 of the top entries while they mingled with Wisconsin cheesemakers and the international panel of judges.
The spectators witnessed a mild upset in the judging. Swiss cheesemakers had won the past three contests, and comprised two of the top three finalists this year. But it was a low-fat Gouda named Vermeer from Friesland Campina, a company based in Wolvega, Netherlands, that took top honors.
The company didn't have any representatives in Wisconsin, but will receive its formal award at a banquet in Madison next month.
Dutch judge Peter Piersma woke up the cheesemaker's plant manager, Piet Nederhoed, with a phone call. It was about 1 a.m. Holland time.
"I got him out of bed so he was a little quiet, but then he got very excited," Piersma said.
Dan Konz, a cheese grader from Kimball, Minn., said the winning Vermeer stood out for its "nice, smooth, clean flavor. It had nice body and mouth-feel. A very clean taste."
Experts compare specialty cheeses to wines: Both have subtle variations based on their region of origin, year of creation and the techniques employed by master craftsmen. The judging protocol is also similar. Judges roll entries in their mouths, search for nuanced characteristics and then discard the samples. Some judges wipe their tongues with napkins between tastings.
While the judges sampled the finalists, spectators did the same with cheeses from countries such as Germany, South Africa and Australia.
"In the past, unless you were a super cheese geek, this is not something you went to," said Jeanne Carpenter, executive director of Wisconsin Cheese Originals, an organization of artisan cheese fans. "But getting to try 15 different cheeses from 15 different countries, plus meeting the best of Wisconsin's cheesemakers, people love that."
Steve Ceder, a painting contractor from Madison, paused from nibbling on cheese Wednesday night to survey the hundreds of fellow connoisseurs who seemed equally delighted to taste new samples.
"Ah, this is Wisconsin," he said, calling the night "a wonderful experience."
The three-day contest began Monday, with judges grading 2,500 entries in 82 cheese and butter classes on flavor, texture, body and color. The winner in each class advanced to the semifinals, where the top 16 were chosen for Wednesday night's finals.
As expected, cheesemakers from the U.S. and Switzerland were extra sharp. Seven finalists were from the U.S. ? five from Wisconsin and one each from Utah and Vermont.
Five other finalists were from Switzerland, including the two runners-up: second-place Kaserei Grundbach, a company in Wattenwill that entered a smear-ripened semi-soft winzer kase; and SO Appenzeller Kase of Appenzell which took third place with its Appenzeller cheese.
While the judges deliberated, Estela Roustan, a Spanish teacher from the Wisconsin Dells, said she was eager to try the samples from Croatia and Spain.
"There's so much variety and diversity here," the 67-year-old said. "It's so wonderful. When you get to taste them, it's almost like you're traveling to different countries."

Hackers busted after one becomes FBI informant
NEW YORK (AP) ? The shadowy underworld of Internet hackers was rocked by news Tuesday that one of the world's most-wanted and most-feared computer vandals has been an FBI informant for months and helped authorities build a case against five alleged comrades.
The FBI said it captured the legendary hacker known as "Sabu" last June, and he turned out to be Hector Xavier Monsegur, 28, a self-taught, unemployed computer programmer with no college education, living on welfare in public housing in New York.
His exploits made him a hero to some in cyberspace until he made a rookie mistake ? he posted something online without cloaking his IP address, or computer identity ? and someone tipped off the FBI.
Soon after his arrest, he pleaded guilty and began spilling secrets, leading to charges Tuesday against five people in Europe and the U.S. and preventing more than 300 attacks along the way, authorities said.
Also charged with conspiracy to commit computer hacking were Ryan Ackroyd, 23, of Doncaster, England; Jake Davis, 29, of Lerwick, Scotland; Darren Martyn, 25, of Galway, Ireland; Donncha O'Cearrbhail, 19, of Birr, Ireland; and Jeremy Hammond, 27, of Chicago. The Europeans were previously arrested in separate hacking cases, though two of them were re-arrested on Tuesday.
Hammond, who was arrested Monday, appeared before a federal judge in Chicago and was ordered transferred to New York. Hammond was charged with crimes related to the hacking in December of Strategic Forecasting Inc., a global intelligence firm in Austin, Texas, that affected up to 860,000 victims.
Law enforcement officials said it marked the first time core members of the loosely organized worldwide hacking group Anonymous have been identified and charged in the U.S.
Investigators said Monsegur and the other defendants were all associated with the group, and some were also part of the elite spinoff organization that Monsegur formed last May, Lulz Security or LulzSec. "Lulz" is Internet slang for "laughs" or "amusement."
Monsegur and the other defendants were accused in court papers of hacking into corporations and government agencies around the world, including the U.S. Senate, filching confidential information, defacing websites and temporarily putting victims out of business. Authorities said their crimes affected more than 1 million people.
Prosecutors said that among other things, the hackers, with Monsegur as their ringleader, disrupted websites belonging to Visa, Mastercard and Paypal in 2010 and 2011 because the companies refused to accept donations to Wikileaks, the organization that spilled a trove of U.S. military and diplomatic secrets.
Also, prosecutors said, Monsegur and the others attacked a PBS website last May and planted a false story that slain rapper Tupac Shakur was alive in New Zealand. Investigators said it was retaliation for what the hackers perceived to be unfavorable news coverage of Wikileaks on the PBS program "Frontline."
But it was the arrest of Monsegur that sent shockwaves through the Anonymous movement, where many described him as a leader and one of the collective's most skilled hackers.
Some Anonymous members put on a brave face.
"Anonymous is a hydra, cut off one head and we grow two back," read one defiant message posted to Twitter.
But the atmosphere in one of the group's chat rooms had an edge of panic. One Anonymous supporter discussed cleaning the group's hard drive. Another warned that if Sabu is cooperating, then "we are all going to have the FBI at are (sic) door."
A Twitter account associated with Monsegur has some 45,000 followers and regularly spouts expletive-filled anti-government messages. His last tweet on Monday was in German and described the federal government as being run by "cowards." It was apparently aimed at concealing his role as an informant.
"Don't give in to these people," the message read. "Fight back. Stay strong."
Monsegur pleaded guilty in August to charges that included conspiracy to commit hacking, admitting he obtained dozens of credit card numbers online and gave them to others or used them to pay his bills.
His deal with prosecutors requires his full cooperation and testimony at any trial. In return, he gets leniency from a potential prison sentence of more than 120 years. He is free on $50,000 bail.
In July, when LulzSec's attacks were grabbing world headlines, someone alleged that Sabu was Monsegur and posted personal details about him on the Internet. Sabu took to Twitter to deny it.
Barrett Brown, a former journalist who became closely associated with Anonymous, said Sabu's cooperation with the FBI could do serious damage to Anonymous.
"He was an admired Anon," he said. "He's been a leader. People came to him with information. God knows what else he told them."

UPDATED 12:15 p.m. PT: Customers of United Airlines?saw improved?service on Sunday?as the airline?worked through technology glitches during its combination of the United and Continental Airlines reservation systems.
On Saturday, United?adopted the reservation platform of the former Continental Airlines after the companies merged to form the world's largest airline, now known as United Airlines and owned by United Continental Holdings.
But after spending months preparing for the change ? including training about 15,000 employees on the new software ? United said on Sunday that technical issues had flared up at airports across the system, causing delays.
In particular, problems with the company's airport check-in kiosks meant customers had instead to line up to see service agents, spokeswoman Megan McCarthy said.
"We did have some issues with our kiosks and at times that slowed the check-in process," McCarthy said, adding that the airline's performance had improved by Sunday morning as the company installed upgrades to the kiosks.
About 75.5 percent of United's mainline flights were on time ? arriving within 14 minutes of their scheduled slot ? on Sunday morning, as were about 87.1 percent of its Express flights, according to McCarthy. "Employees are working hard to take care of our customers," she said.
Original story: In a final step of its merger, United-Continental on Saturday performed a massive procedure consolidating two IT systems into one, a process called a ?cutover.? The transition?has gone relatively smoothly, though some fliers have been affected by missed connections and late departures and arrivals.

In an e-mail to msnbc.com, United Airlines spokesperson Rahsaan Johnson said one system is now supporting the carrier. "The system conversion involves moving millions of reservations and re-establishing numerous communications links. The vast majority of this work is going well, and we are resolving technical issues that we are identifying during this process," he said.
?As a letter grade, I give them a B-,? said Joe Brancatelli, frequent flier and publisher of business-travel newsletter JoeSentMe. Most problems, he said, have been reported at pre-merger United hubs such as Dulles International in Washington and O'Hare International in Chicago. Former Continental hubs, he observed, have not had as many problems.
As for the delays at Dulles and O'Hare, Johnson said the airline is working "to speed up airport kiosks, which at times have slowed check-in," but added "most of our flights have either departed on time or within 30 minutes of the scheduled departure time.
As of 5 p.m. ET, United's on-time percentage for departures out of O'Hare was at 16 percent, according to Flightstats.com. Out of 83 tracked departures, one was canceled, 28 were delayed between 15 and 30 minutes, 20 delayed between 30 and 45 minutes and 21 were delayed more than 45 minutes. By comparison, American Airlines' on-time percentage out of O'Hare was 85 percent.
?Barring an absolute meltdown, the electronic side has gone as well as expected,? Brancatelli told msnbc.com. ?In fairness, I don?t see the gigantic problems we?ve seen with other cutovers.?
Recent history is littered with cutovers that didn?t go quite as planned. Perhaps the most infamous snafu took place in 2007 when US Airways tried to integrate the systems of merger partner America West. The result? Out-of-order kiosks, long lines, flight delays and lots of inconvenienced and angry customers.
More recently, Virgin America and?Cathay Pacific?have suffered IT-migration meltdowns that impacted travelers? ability to manage reservations, access mileage plan accounts or talk to a reservation agent.
As for United's cutover, ?people haven?t lost a seat or not been upgraded, but it?s not running as smoothly as it should,? Brancatelli said, adding that problems will be fixed in the days ahead, but said the issue today is moving people through the system.
Continental's last flight, 1267, departed from Phoenix at 11:59 p.m. PST on Friday and arrived on-time in Cleveland as United 1267 on Saturday morning.
The airline will stop using Continental's "CO" code. That means no more Continental Airlines tickets, or flights ? even though the Continental name is still painted on some planes.
If you?re traveling today, Brancatelli urges carrying on your luggage if you can, printing out everything, leaving for the airport early and allowing plenty of time, and if you?re not flying over the next few days, staying off United.com.
?Don?t obsess that all the miles you?ve rode haven?t caught up. They will. Today is about people traveling now,? he said.
United and Continental have gone to great lengths to lay the groundwork for a successful transition. Earlier this week, United's Johnson said the carriers?conducted four dress rehearsals, successfully migrating the data from United?s Apollo-based system to Continental?s SHARES-based one.
?As in any dress rehearsal, we figured out potential issues that might arise, fixed them and developed procedures in case they arise again,? he said.
The last flight will mark the completion of the takeover of Continental by United. NBC's Brian Williams reports.

Wandering gray wolf leaves California, returns to Oregon
The wandering gray wolf who last year became the first wild wolf recorded in California since the 1920s crossed the border Thursday and headed back to his home state of Oregon.
The young male, nicknamed Journey by a conservation group, entered California in late December, attracting international attention. He remained on the move, trotting nearly 1,000 miles in three Northern California counties, crossing highways, pine forests, scrubland and even ancient lava flows.
Biologists say OR7, as the animal is officially known, is doing what young wolves do: setting out on its own to find a mate, establish a new pack or perhaps join another one.
Having apparently accomplished none of that in the Golden State, he headed north. At midnight Thursday, readings from his GPS collar placed him in Jackson County, Ore.
"There's just no place like home," tweeted one of his followers. "Back in Oregon where there's no sales tax. Outlet mall here I come!," tweeted another.
Where the wolf will go next is anyone's guess. He could just as easily lope back to California as remain in Oregon.
"He was predictable in his unpredictability," said Karen Kovacs, a wildlife program manager for the California Department of Fish and Game.
She said biologists were astonished at the animal's ability to return to areas he had visited and marked with urine. And while it is not uncommon for young males to travel long distances when in "dispersal," Kovacs said this wolf's marathon meanderings stood out.
Since he left his home pack in northeastern Oregon in September, OR7 has traveled more than 2,000 miles as measured in straight lines on a map ? meaning that, in actuality, he has covered far more ground. "Just incredible," Kovacs said.
The wolf traversed private ranch land and public lands in Siskiyou, Shasta and Lassen counties.
Kovacs said there are no confirmed photographs of the animal in California. But based on satellite data, her department believes one person ? possibly two ? photographed his saucer-sized paw prints and another two may have caught brief glimpses of him in the state.
Most of the reported wolf sightings, which came from as far south as Sonoma County, were large dogs or coyotes. "We got sightings of wolves all over the place," Kovacs said.
Although OR7's home pack has killed livestock in Oregon, he stuck to wild prey in California. Kovacs said he was not connected to any livestock losses and biologists found evidence that he had dined on deer carcasses.
Hunted, trapped and poisoned, gray wolves disappeared from California nearly 90 years ago. After they were successfully reintroduced to the northern Rockies in the 1990s and started spreading West, biologists say, it was just a matter of time before one showed up in California. But it could be years before the state can boast an established pack.

Liquid Television: An Alternative to the Reality.
They?ll be promoting their favourite liquid loops throughout the month so it could be a great opportunity for you to gain some international exposure!
If that?s not enough to get you motivated they?ve also provided us with a glorious prize pack of goodies for both the winner and runner up!
The submission rules are simple;
- it must be made by you,
- it must suit the month?s theme,
- it must be engaging,
- it must be submitted in one of our specified formats,
- it must not contain pornographic material, incite hatred or include defamatory or discriminatory content,
- it has to loop!
- in the spirit of Liquid Television we are looking for fresh new independent work, so
as tempting as it is please avoid making parodies or tributes to past MTV characters.
Selected loops will be posted within five days of submission for everyone to enjoy, comment and rate, and all posted loops will screen at Loop on Tuesday March 27th from 7:30pm.
